Terms & Definitions

The terms below will have the following meaning:

  • Service Provider: Means TEŽINSKI GRAF d.o.o., Ulica Ljudevita Posavskog 34A, 10000 Zagreb, Hrvatska, PIN/VAT: HR66900544338 owner of the Platform.

  • Customer: This means a person who signed the Purchase Order for access to the Platform; Customer appoints and manages with Users associated with his/her Customer account. Customer is also included within the term „User“ when Customer accesses and uses the Platform.

  • User: Any person using the Platform either as a Customer or being included in an active Customer subscription to the Platform.

  • Party(ies): This means in singular each Customer and Service Provider while in plural both Customer and Service Provider. Users are not party hereto although may be included in the Subscription Plan.

  • Subscription Plan: This means features are available to Users when accessing and using the Platform. Currently, there are multiple subscription plans described in more detail on Product & Services Catalog.

  • Platform: This term refers to the service provided to Customers via the Website, which may also include a mobile application. The Platform excludes products and/or services offered by Marketplace Partners and any content created or published by the Customer through the Platform. The Platform encompasses services provided solely by the Service Provider, including those detailed in the Product & Services Catalog.

  • Website: means www.marty.hr.

  • Candidates: Means a natural person engaged in HR processes by the Customer via the Platform.

  • Visitors: anyone who accesses our Website.

  • Privacy Policy: This means the Privacy Policy, as amended from time to time. This document gives Customers and Users information on how the Platform processes their personal data but also how Users may use the Platform to process Candidate personal data.

  • SLA: This means the Service Level Agreement.

  • Terms and Conditions: This means the Terms and Conditions, as amended from time to time. This document gives Customers and Users information on how the Platform may be used and what constitutes prohibited use.

  • DPA: This means the TalentLyft Data Processing Addendum.

  • Purchase Order: This means the purchase order with which the Customer orders services from the Service provider.

  • Service Provider Documentation: means Terms and Conditions, Service Level Agreement, Data Processing Addendum, Privacy Policy, as amended from time to time.
