1. Beta Product

The Service Provider may offer access to pre-release versions of software, features, content, documentation, or services (“Beta Product”) for testing and evaluation purposes. Participation is voluntary and subject to this Agreement. The Beta Product is provided at the sole discretion of the Service Provider and may be modified, suspended, or discontinued at any time without notice.

2. License Grant

The Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to use the Beta Product solely for internal evaluation and non-commercial purposes.

You may not, directly or indirectly:

  • Rent, lease, sell, sublicense, or redistribute the Beta Product;

  • Modify, adapt, reverse engineer, decompile, or create derivative works based on it;

  • Use the Beta Product in production or mission-critical environments.

3. User-Generated Content

If you create, upload, or share content (e.g., feedback, testimonials, suggestions, data) via the Beta Product (“User Content”):

  • You grant the Service Provider a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, display, distribute, and publish such content.

  • You represent and warrant that your content does not infringe on third-party rights and is not defamatory, offensive, or unlawful.

4. Acknowledgment of Beta Nature

You acknowledge and agree that:

  • The Beta Product is experimental and may be incomplete, unstable, or contain errors;

  • Features may be added, modified, or removed without notice;

  • The Beta Product is provided without service-level commitments (e.g., uptime or support);

  • The Service Provider is not obligated to release a commercial version;

  • You are solely responsible for backing up and safeguarding your data.

5. Disclaimer of Warranties

The Beta Product is provided “as is” and “as available,” without warranties of any kind. To the fullest extent permitted by law, the Service Provider disclaims all warranties, express or implied, including:

  • Merchantability,

  • Fitness for a particular purpose,

  • Non-infringement,

  • Accuracy or reliability of the Beta Product.

The Service Provider shall not be liable for any losses, damages, or claims, including but not limited to loss of data, business interruption, or loss of profits.

6. Feedback

You agree to provide timely feedback, suggestions, bug reports, or enhancement requests regarding the Beta Product (“Feedback”).

  • All Feedback becomes the sole property of the Service Provider;

  • The Service Provider may freely use or incorporate Feedback into its products or services without any obligation to you;

  • Feedback does not entitle you to any rights in or to the Beta Product or any final offering.

7. Confidentiality

The Beta Product and all related information (including its features, performance, and documentation) may be considered confidential. You agree to:

  • Keep all such information confidential using reasonable care;

  • Not disclose it to any third party without written consent from the Service Provider;

  • Use it only for evaluating the Beta Product as permitted under this Agreement.

These confidentiality obligations survive the termination of this Agreement.

8. Term and Termination

  • This Agreement is effective from your first use of the Beta Product and continues until terminated by either party.

  • The Service Provider may terminate your access to the Beta Product at any time, for any reason, without liability.

  • Upon termination, you must stop using and delete all copies of the Beta Product.

9. Miscellaneous

  • Governing Law: This Agreement is governed by the same law and jurisdiction as the main service agreement between the Parties.

  • Severability: If any provision of this Agreement is found unenforceable, the remainder shall remain in full force and effect.

  • Entire Agreement: This Agreement constitutes the full understanding between the Parties regarding the Beta Product and supersedes any prior communications.
